A federal judge has granted a temporary restraining order against the sale of counterfeit erectile dysfunction drugs, including Viagra and Cialis, following a US court ruling in the case of the US District Court for the Eastern District of New York.
The case was brought by a man who was accused of selling illegal drugs and receiving a substantial amount of the counterfeit drugs from his online pharmacy.
He was sentenced to serve up to six years in federal prison and fined $1.2 million, according to the US Justice Department. The Food and Drug Administration has approved the sale of the drugs and is investigating the case.
The man had claimed that he was an "unconventional," "unlicensed" individual. He was also accused of selling illegal drugs and receiving a large amount of the counterfeit drugs from his online pharmacy, the US Attorney's Office for the Northern District of Illinois said.
The judge's ruling was based on the government's showing that consumers who purchase drugs from an online pharmacy in the United States are often more likely to get the drugs from legitimate sources and to purchase the drugs from those who do not pay. The FDA has said it believes that the counterfeit drugs are particularly dangerous.
In May, the US Food and Drug Administration warned that those who purchase drugs online are more likely to get the drugs from "unlicensed sources". The FDA said it is "incorrect" and that it is investigating further.
The man pleaded guilty to one count of conspiring to traffic in and selling drugs and a misdemeanor charge of selling the drugs online.
He also received a criminal information under the Food and Drug Act, which gives the FDA broad authority to inspect drugs and other medicines sold online.
The judge said the defendants had offered "substantial assistance" to the defendants in obtaining drugs from their online pharmacy and had made a "good faith effort" to obtain those drugs from the drug sellers.

ViagraConnect manufacturer, Pfizer, estimates more than a fifth of men aged over 18 in Britain suffer from erectile dysfunction, but almost half of those over 40 have not sought medical help.
The erectile dysfunction drug will be available in 14,000 stores across Britain and via pharmacy websites.
The tablets will be available exclusively from Boots until 10 April.
Those aged 18 and over will be able to buy the tablets following a conversation with a pharmacist or after filling out an online form. Men can ask to speak to a pharmacist in a private consultation room if preferred.
